is it ok to sell a clean set of cd-keys with no account attacted to them?

As far as I know that is also against the EULA.

Once the game has been purchased then they have made their money - you sell it to someone else and you are making the money reguardless of if its been used or not.

Hmm im not sure about this, since you didnt agree to the eula yet..
But still the answer is no i believe.

On the GW box :
Important :Not valid for purchase if opened.Not valid for resale by prior owner.Acceptance of certain agreements is required.Players are responsible for all apllicable fees.

So by that part it already says that because you already owned it you can not sell it.
The whole no resale thing is to protect potential buyers from scammers, so in my opinion if you have a soccerfriend (example..) and you know he likes these kinds of games and you want to sell it to him , go ahead.

If you are the one trying to buy this ( from someone you dont know, or only know from internet) DO NOT do it.Its too easy too scam.

I see no harm in a transaction between friends. It's like, you picked it up for him while you were in the store and he's now giving you the money for it. I can't see anything illegal, shady or scamming in that.

IANAL, but I don't think they can prevent this legally. Maybe it depends on the jurisdiction, obviously local, state and federal laws supercede EULAs.

I got my factions copy via a friend as i don't have a CC. Is that illegal?? Anet got their money, my friend got his. i don't see anything wrong.

did your friend get it online?

you don't need a CC to buy the game since you can buy it locally from your retail or game store unless you're in one of those middle of nowhere locations.

I know it is against the eula, but he did not agree to it yet!
Im assuming he bought a second gw but never used it, he didnt open it, it was just in his closet collecting dust.

And im pretty sure your right Carinae,the only reason i can see why that is there is so they have to power to ban you for that part alone.

he got it shipped from an online store (i have the case and all)

Also i'd rather NOT buy it locally. it costs waaaay too much from here (like 20 euros more than normal)

The EULA isnt law its a contract between you and who ever owns the rights to the game, selling a fresh cd key or the whole boxed game is perfectly legal also if its an unused cd key the EULA hasnt been agreed to therefor no contract has been accepted.
Now I dont care what anet say or anyone else once you buy something its yours to do what you like aslong as you are not infringing on the copy rights.
Lets say you buy a car or a house, tv what ever and the company says to you once you buy it you cant resell it what would you do, you would laugh.
Therefor anet legaly cant do anything about it.

Even if the EULA says "Anet has the power to kill you at will." and you agree to it, it still doesn't count. Local, State and Federal laws supercede EULAs, and often certain rights are inalienable, which means you can't surrender certain rights.

They add it to the EULA knowing full well that it will be overridden in most jurisdictions, but so what? They aren't out anything if it's not allowed. Plus they could ban you and MAKE you fight them in court, which is easier for them than you.

Are you talking about selling an unopened copy to a friend? or selling 5000 previously owned copies on Ebay? There is a difference.

Against EULA.. but let just said that someone here probably done it before. Selling it and if A-Net found out about it, usually result in the account getting lock down or banned.

Ok, it's against the EULA, however, the intention of that is part warning against people who buy from eBay. Someone could buy a copy from Plaync via credit card, sell the key via eBay, and the cancel the sale on their credit card. ANet then kills the account and the person who bought it from eBay is out their cash with no real recourse. If your friend bought the game from a store and then you bought it from him without things every having been opened, I doubt ANet would have any serious issues with it, unless your reasoning is to circumvent a stores policies on not selling certain games to people under a certain age, etc. It is against the eula though, so buyer beware.

that kinda sux i mean im not going to try and sell my account which has 6 lvl 20's with 15k armor , im going to delete the account and sell the cd-key i mean shit i paid 100$ to have both games 100$ worth of my hard earned money and now i can't make a little money back ? thats jacked up.

p.s. i haven't did this and if its against the rules then i won't.

As long as it is unopend it's perfectly legal, if the key have not been opend and applied to an account, the content of the box is legally yours untill you go online and register an account. You can buy a game box and give as a present, and you can buy a game box and resell it, same as the stores do.

If the key has never been used, it may be against the EULA... but then again there is no way for anet to know it was a resale key (since it's never been active).

actually that is the problem as even Anet/NCsoft is not able to delete an account.

once it has been created thats it.

the most they can do is perma lock it but they cannot alter/delete the core account you created and have a fresh key to set up a new account
